Article 1 – Definitions
* Seller: The party offering and selling the commemorative pins: the Arnhem-West Airborne Commemoration Committee.
* Buyer: The natural person or legal entity purchasing a commemorative pin from the Seller.
* Product: The commemorative pin(s) and any associated packaging or accessories.
Article 2 – Applicability
1. These terms and conditions of sale apply to all offers, orders and agreements relating to the commemorative pins.
2. By placing an order, the Buyer agrees to these terms and conditions.
Article 3 – Offer and Formation of the Contract
1. All offers are non-binding and valid whilst stocks last (for example, in the case of a limited edition).
2. The contract is formed at the moment the Seller has confirmed the Buyer’s order electronically or in writing.
Article 4 – Prices and Payment
1. All prices quoted are in euros (€) and include VAT, unless expressly stated otherwise. This excludes any delivery charges.
2. Payment must be made in advance using the payment methods specified on the website or in the invoice. The Seller will only dispatch the Product upon receipt of full payment.
General Terms and Conditions of Sale – Commemorative Pin
Article 5 – Delivery and Risk of Loss in Transit
1. The Seller endeavours to dispatch the Product within the specified delivery period. Stated delivery times are indicative and shall never be regarded as a strict deadline.
2. The risk of damage to or loss of the Product during transport remains with the Seller until the moment of delivery to the Buyer (in the case of a consumer purchase).
Article 6 – Right of Withdrawal (Returns)
1. **Consumer purchase:** The Buyer has the right to withdraw from the purchase within 14 days of receipt without giving any reason.
2. The Product must be returned in its original, undamaged packaging and unworn (if it is a piece of jewellery or a pin). The costs of the return shipment are to be borne by the Buyer.
3. **Exception:** If the commemorative pin has been specifically personalised (for example, with an engraving of a unique name or date at the Buyer’s request), the right of withdrawal lapses in accordance with the statutory provisions.
Article 7 – Conformity and Warranty
1. The Seller warrants that the commemorative pin complies with the contract and meets reasonable requirements of quality and fitness for purpose.
2. Minor variations in colour, finish or dimensions (which may be inherent in the production process of metal/enamel pins) shall not constitute grounds for rejection or compensation.
3. Complaints regarding visible defects must be reported to the Seller in writing, stating the reasons, within 7 days of receipt.
Article 8 – Liability
1. The Seller’s total liability for any attributable failure to perform is limited to compensation for direct loss up to a maximum of the price stipulated for that contract (excluding VAT).
2. The Seller shall not be liable for damage resulting from misuse (for example, damage to clothing caused by the pin or the swallowing of small parts by children).
Article 9 – Governing Law and Disputes
1. All legal relationships to which the Seller is a party shall be governed exclusively by Dutch law.
2. Disputes shall in the first instance be submitted to the competent court in the judicial district where the Seller is established, unless the law mandatorily prescribes otherwise.
